Oh right, Apple also sued Samsung for copying their hardware. This one is a bit more legit though that I've been told. The only real difference between the two things were a bigger case. The insides of a handful of Samsung products were basically iPod/Pad ripoffs.

Got them in the States, but in Japan, they lost their suit. Don't know how things went down in Europe though.

That case only cemented that Apple has exclusive rights to the shape of rectangular with rounded edges and that the patent office is an utter joke. I mean they have a 'legitimate' patent on a feature that makes the screen do an animation when you attempt to scroll past the end.

What it comes down to is that the jury had no clue about technology and sided with their favorite, Korea had a similar case going on at the same time and do you think they gave Samsung a landslide victory? No it was split with both treading on each other's patents. Which is to be expected given the rate of change of consumer electronics doesn't allow for years and years of patent time.

You are right about this patent bullshit. Okay, I can understand for an entirely revolutionary device, or even just a simple model of your own thing that's been made a million times. But really? They got them on shapes?

It's called trade dress, if the product looks too similar then it's treated like a copyright violation essentially.

The problem being that all phones are going to look similar because that's what consumers WANT. Apple simply highlights how broad they think their brand rights should be with the cases I linked earlier. Several of the devices Samsung got sued for even had different button lay outs (which you'd think would be a major appearance factor) but at the end they still lost. It's a law that was intended to prevent knock offs (like for clothes and accessories), but Apple is using it to hurt it's competition by making competitors go to excessive lengths to 'look different'.
